General Terms and Conditions - GTC
The Rental Agreement:
The fixed-term rental agreement for the property is concluded between you as the tenant and Bessis Immobilien Mourad Bessis. The subject of the contract is the temporary use of a rental property for residential purposes.
1. The tenant may withdraw from the rental agreement at any time or provide a replacement tenant. The declaration of withdrawal or replacement is effective from the day it is received by the landlord (the term "host" implies an invitation, i.e. free of charge). To avoid later misunderstandings, written form (letter, fax, email) is strongly recommended! No costs will be incurred by the tenant for a cancellation up to 12 weeks before the start of the rental period. Any advance payment made will be refunded. For cancellations after the 11th week before the start of the rental, the host may request reasonable compensation on behalf of the landlord in accordance with § 651 j BGB.
The compensation amounts to:
a.) for cancellations from 12 to 08 weeks before the start of the rental: 20% of the rental price
b) for cancellations from 08 to 04 weeks before the start of the rental: 50% of the rental price
c) for cancellations from 04 to 02 weeks before the start of the rental: 80% of the rental price
d) for cancellations from 02 weeks before the start of the rental or in case of no-show: 100% of the rental price.
Complaints must be reported to the landlord immediately or at the latest within 24 hours. The landlord will endeavor to resolve any deficiencies within a reasonable time.
The tenant agrees to protect the rented premises and inventory from damage and to return everything, including all keys and accessories listed in the inventory, at the end of the rental period. Damaged or unusable items must be replaced in a way that does not cause any disadvantage to the landlord.
Furthermore, the tenant agrees not to take any action that is harmful to the rental property or its inventory, to promptly report anything that appears defective or harmful, and not to sublet the property in whole or in part. The premises may only be occupied by the persons listed below.
Legal effect of electronic media: The management reserves the right not to recognize claims arising from the misuse of the website, email data, or email addresses.
The tenant is responsible for any damage to the property or inventory caused by negligence. Missing items from the inventory list must be replaced at the tenant's expense. No clogging materials may be disposed of in the toilets or drains.
Smoking is not permitted in the apartment. The fireplace is decorative and must not be used. Pets are not allowed in the apartment unless explicitly approved in writing by the landlord. This may result in a negotiable rental arrangement. Telephone and other charges will be settled at the end of the rental period.
In case of disputes arising from this agreement, the place of jurisdiction shall be the location of the rental property. German law shall apply.
